August 2026 Europe's medical technology sector remains the world's second-largest, valued at roughly €170 billion in 2024. But a certification backlog running into the tens of thousands of applications — compounded by limited clinical trial site capacity — is reshaping how manufacturers think about where clinical evidence gets generated.

The Certification Backlog

The European Commission's 18th Notified Bodies Survey (March 2026, data through October 2025) recorded 33,175 MDR applications submitted against 17,549 certificates issued — a gap of more than 15,000 applications still in process across 51 active Notified Bodies. Standard review timelines now run 13–18 months, extending to 24 months or more for higher-risk devices, with incomplete documentation and weak clinical evidence among the most common findings.

Why Sites Are Also a Bottleneck

Part of the delay traces further upstream than Notified Body queues. Europe's share of global clinical trials fell from 22% in 2013 to 12% in 2023 — an estimated 60,000 fewer trial places for European patients — as site readiness, investigator and staffing constraints, and slow ethics-committee timelines failed to keep pace with rising trial volume (EFPIA, 2026). Only 40% of trials achieve first-patient recruitment at the first site within 200 days, against a 66% target set for 2030, and more than half of sites report taking longer than five months from selection to activation. Fewer active research hospitals and investigators translate directly into longer waits before evidence generation can even begin — a constraint that compounds, rather than duplicates, the certification backlog downstream.

What's Changing in 2026

On May 4, 2026, the European Commission adopted new maximum Notified Body timelines (30/120/90 days for application review, QMS audits, and product verification). A separate May 7 agreement under the Digital Omnibus package pushed back AI Act deadlines for medical devices to August 2028 (embedded AI) and December 2027 (standalone high-risk AI).

The Cross-Border Validation Response

With both certification queues and clinical site capacity constrained, cross-border clinical validation is increasingly cited as one way manufacturers manage evidence-generation timelines. India is the most frequently referenced market: CDSCO's 2019 reforms cut trial approval timelines to 30–90 days, its clinical trials market is projected to grow from $2.05B (2024) to $3.37B by 2030, and study costs typically run 30–40% lower than equivalent EU trials.

This isn't a substitute for EU certification — evidence generated abroad still has to meet MDR's evidentiary standards — but it's increasingly a factor manufacturers weigh alongside the EU's own process.
